Chen Canping: Brief Introduction to the "Private Economy Promotion Law"

On the evening of November 20, 2025, a lecture themed "A Brief Introduction to the 'Private Economy Promotion Law'" was successfully held in Conference Room 410, Xingmin Building, Xianlin Campus, Nanjing Normal University. Professor Chen Canping, Deputy Procurator-General of the Tianjin People's Procuratorate and part-time doctoral supervisor of legal economics, was invited as the keynote speaker for this lecture. Professor Cai Daotong from the School of Law, Nanjing Normal University, served as the moderator for the lecture, while Associate Professor Chen Hui, Teacher Fan Jingzhao, and Teacher Yang Jianmin served as panelists. Students from all grades of the undergraduate and graduate programs in the School of Law actively participated in the discussion and exploration of the "Private Economy Promotion Law".

In the first part of the lecture, Professor Chen Canping analyzed the milestone significance of the "Private Economy Promotion Law" from three perspectives: politics, rule of law, and economy. He pointed out that the promulgation of the "Private Economy Promotion Law" is a fundamental requirement for implementing the decisions and deployments of the Party Central Committee at the political level, an inherent requirement for implementing the provisions of the Constitution and adhering to the basic economic system at the rule of law level, and an objective need for building a high-level market economy and promoting high-quality development at the economic level. He mentioned that, under the classification of demonstrative legislation, management-oriented legislation, and promotion-oriented legislation in legislative studies, the "Private Economy Promotion Law" belongs to the category of promotion-oriented legislation, whose content is to restrict the exercise of public power and stipulate the duties of public power to strengthen the guidance, support, and encouragement of the private economy. He emphasized that the "Private Economy Promotion Law" is China's first basic and comprehensive law specifically targeting the development of the private economy, achieving a historic leap from "decentralized protection" to "system integration", from "policy guidance" to "legal norms", and from "response and support" to "leading and promotion".
Immediately afterwards, Professor Chen Canping provided a detailed interpretation of the key provisions of the "Private Economy Promotion Law". He pointed out that the law confirmed for the first time at the legal level that the private economy is an important component of the socialist market economy, granting it a clear legal status and development rights, providing a "reassurance" to the vast number of entrepreneurs. On this basis, the "Private Economy Promotion Law" established a nationwide unified negative list system for market access, truly realizing "entry without prohibition", and providing a direct legal basis for clearing various hidden barriers. It is noteworthy that the law comprehensively protects the legitimate rights and interests of private economic organizations, such as intellectual property rights and personality rights, while strictly regulating the exercise of administrative power. It sets clear boundaries for acts such as expropriation, seizure and freezing measures, compulsory measures, and off-site law enforcement, strictly preventing abuse of power. In addition, the "Private Economy Promotion Law" innovatively establishes mechanisms such as policy adaptation and adjustment periods, credit restoration, etc., reflecting the restraint of the rule of law and respect for market entities.
At the end of the lecture, Professor Chen Canping gave a message to the students, hoping that they would understand that "the life of law lies in logic, experience, and the combination of logic and experience", and that "law is deep rationality". Finally, Professor Chen encouraged the students to have confidence in the legal profession. Professor Cai Daotong highly praised Professor Chen Canping's wonderful lecture, pointing out that the entire lecture not only had a precise grasp of the legislative spirit but also in-depth reflection on procuratorial practice, as well as a forward-looking perspective on the future construction of the rule of law. Professor Cai Daotong particularly emphasized that this lecture was not only a transmission of professional knowledge but also a training in legal thinking. He encouraged the students to conscientiously study Professor Chen Canping's research method of closely combining academic research with judicial practice and cultivate a keen sense of questioning.
